Join our discussion with Acting Deputy Chief Administrative Patent Judge Kalyan Deshpande on the evolving PTAB institution landscape under U.S. Patent and Trademark Office Director John Squires.
Panelists will explore key developments as a result of Director Squires’s recent institution decisions, including strategic considerations for practitioners navigating these decisions, and what early data from Squires’s instituted reviews may suggest about future trends. Topics will include the role of settled expectations, parallel proceedings, the use (or absence) of written explanations in Squires’s decisions, and early indicators of how discretionary factors are being weighed in practice.
The discussion will also address what practitioners believe might improve predictability in institution decision-making going forward.
