PTAB Bar Association Program Committee Webinar:
“Continuing Evolution of Discretionary Denials at the PTAB”

The growing volume of discretionary denials continues to shift the ground under the PTAB bar. This webinar will provide practitioners and clients with perspectives from seasoned PTAB outside counsel on how to address the numerous issues that these discretionary denials present, as both patent owners and petitioners try to navigate between the Scylla of Fintiv and the Charybdis of settled expectations.
Practitioners will discuss the effects on their practices, potential strategies for obtaining successful outcomes in this new landscape, policy implications, and how they are advising clients, both on already-filed IPR petitions and on whether to file petitions at all. There will be time left specifically for questions. Attendees will have the opportunity to guide the discussion by providing questions in advance, as well as during the webinar.
