“Evolution of PTAB Practice: Guidance on Discretionary Denials”

Join us to discuss the recent policy updates to discretionary denials at the PTAB.
As a result of the rescission of former USPTO Director Kathi Vidal’s June 21, 2022 Memorandum regarding discretionary denials in PTAB post-grant proceedings, and the institution of a new discretionary denial process by Acting Director Coke Stewart, practitioners and clients are seeking guidance on how to proceed under this changing landscape.
Panelists will discuss recent decisions related to discretionary denials, including factors such as settled expectations, trial dates, the presence of parallel proceedings, and other issues. Panelists will discuss approaches to navigate the most recent Board decisions on discretionary denials, including a consideration of jurisdictions with aggressive scheduling orders and expedited timing. The panelists will discuss how the PTAB’s current approach has impacted their strategic decision-making processes and what, if any, changes might improve the overall process.
